Terms of Sales

1. Preamble

The following general conditions of sale govern all transactions established on the web catalog of Société de Développement Touristique Souss Massa. Any order placed on this site assumes the customer’s unconditional and irrevocable acceptance of these conditions.

2- Object

This contract is a distance contract which aims to define the rights and obligations of the parties in the context of the sale of the products of the company Société de Développement Touristique Souss Massa S. A, on the Internet. www.agadir-oufella.ma is a service and a trademark registered by Société de Développement Touristique Souss Massa S. A.

3- Definitions

In the remainder of the contract, each of the expressions mentioned above will be understood in the sense of its definition, namely:

Remote contract

any contract concerning goods or services between the Company Société de Développement Touristique Souss Massa and a Consumer as part of a remote sales or service provision system organized by the Company Société de Développement Touristique Souss Massa Who, for this contract, uses exclusively the Internet network until the conclusion of the contract, including the conclusion of the contract itself.

Consumer

any natural person who, in this contract, acts for purposes which do not fall within the scope of his professional activity.

Command

act by which the Consumer undertakes to purchase Products and the Company Société de Développement Touristique Souss Massa.

4- General dispositions

Company

Société de Développement Touristique Souss Massa, public limited company with share capital of
21,500,000.00 dirhams, registered in the Agadir commercial register under number 39225, whose head office whose head office is located at (N°A208, 2nd floor Lawyer’s building 2 high Founty

Acceptance

The Consumer declares to have read the General Conditions of Sale before placing an order and to have accepted them without reservation.

Modification of the general conditions of sale

The Company Société de Développement Touristique Souss Massa reserves the right to modify these General Conditions of Sale at any time. The applicable General Conditions of Sale are those in force on the date of the order placed by the Consumer.

5- Orders

Definitive nature of the order

Orders placed on the website constitute a firm and definitive commitment, and after confirmation of said order by the company Société de Développement Touristique Souss Massa by email to the email address communicated by the member.

Order modification

Orders being final and irrevocable, any modification request made by the Consumer is subject to acceptance by the company Société de Développement Touristique Souss Massa.

Validity of the order

The company Société de Développement Touristique Souss Massa reserves the right to refuse any order for legitimate reasons and more particularly in the case where the quantities ordered are abnormally high compared to the quantities usually ordered by consumers.

6- Prices of the ordres

The price is expressed in DIRHAMS. The price indicated in the order confirmation is the final price, expressed including all taxes;

7- Delivery of tickets

The ticket is issued electronically, it can be printed at home and has a unique bar code. It is impossible to be admitted to the entrance several times with the same ticket. Reproduction of tickets is prohibited and will not provide you with any benefit. Only the first person to present the ticket will be admitted.

Your printable tickets at home are permanently available until the date of the event on the website in the “My Orders” section.

The purchaser of tickets takes all precautionary measures required to keep his password secret and to prevent any use by unauthorized persons or any infringement.

In any event, the company Société de Développement Touristique Souss Massa cannot be held responsible for the non-delivery of the ticket to the member, if this non-delivery is due to the communication of erroneous information by the consumer .

When the ticket is sent to the address indicated by the Consumer, it is up to him to check the nature of the ticket sent and, in the event of an error, to express reservations, possibly to refuse the ticket, and to notify the company Société de Développement Touristique Souss Massa within 48 hours.

8- Cancellation, Refund, Use

Tickets purchased are not subject to a right of withdrawal

A ticket cannot be refunded, even in the event of loss or theft, nor returned or exchanged. In the event of cancellation of tickets for exceptional reasons (exceptional closure), only the price of the ticket will be refunded. This reimbursement will only be made in favor of the initial purchaser against surrender of the ticket.

No duplicate ticket can be issued, including in the event of loss or theft.
When checking at the entrance to the Kasbah, you may be asked for a valid photo ID and it must match the name written on the ticket.

Upon announcement of the cancellation or modification of the date, time or place for which you have reserved your ticket, you accept that the company Société de Développement Touristique Souss Massa, to the extent possible , can use the contact details you entered when booking to keep you informed of what to do.

9- Value

The value of the Vouchers is that in force on the day of confirmation of the order by the Consumer as mentioned in article 5.1 above.

10- Recording the value of the Purchase Voucher

Demandability

The value of the ticket is recorded when ordering, once it has been confirmed by the company Société de Développement Touristique Souss Massa.

Payment methods

The Member has only one payment method:

– By bank cards: The company Société de Développement Touristique Souss Massa accepts Moroccan and international bank cards on its website. Payment is made via the Payzone platform.

This solution is certified by the interbank electronic payment center and 100% secure.

11- Dispute resolution, applicable law and competent jurisdiction

Complaint

Applicable law and competent jurisdiction

The General Conditions of Marketing are governed by Moroccan law. Any dispute relating to the order or these General Conditions of Sale will be submitted to the competent court.

12- Computing and freedoms

The information collected on the site www.agadir-oufella.ma is subject to processing intended to ensure the processing of the consumer’s reservation, as well as to reinforce and personalize communication in particular by information letters/emails, and finally to personalize its website according to the preferences observed by consumers.

14- Deletion of data

15- Force majeure

The company Société de Développement Touristique Souss Massa is only liable for the execution of its obligations to the extent that no force majeure event hinders them.
